After selecting property to buy in Albania and signing the Albanian Property reservation agreement the property is held for usually up to a period of 4 weeks. During this period you can make your necessary checks and obtain the relevant information. The main contract can be drawn up by the property solicitor. It includes the timescales, payment terms, the property purchase price and the terms and conditions of sale. Make sure that you have copies of all contracts in English so you understand it.
The Albanian property preliminary contract is signed in front of the ‘Notary Public' by all the involved parties, this is effectively a promise to enter into a final contract to buy/sell the property After the preliminary contract a deposit between 20-40% of the sale price is paid. The remaining balance is paid in stages as agreed with the developer and confirmed in the contract. These stages of payments can differ from developer to developer.
The Notary is basically an official representative who plays a major part in the process of buying and selling real estate in Albania. He acts as a witness to the signing of all the Albanian property contracts and makes sure everything is according to the legal requirements. After the final purchase contract is signed in front of the notary, the right of ownership is transferred to the buyer and the property added to the public record showing the official transfer of title deed to the buyer.
You should expect to pay around 800 Euro for all your legal fees, which will also include Notary fees, taxes and transfer fees.
